Terms of Service

1. Eligibility

You must be at least 18 years of age to use GateSpark. By using the Service, you represent and warrant that you are 18 or older, that you have the legal capacity to enter into these Terms, and that you are not prohibited from using the Service under any applicable law. GateSpark reserves the right to verify your age and to terminate accounts of users who misrepresent their age.

2. Account Registration

To access most features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You may not create an account on behalf of another person, use a false identity, or create multiple accounts. We reserve the right to suspend or terminate accounts that violate these Terms.

3. The Service

GateSpark is a location-based social platform exclusively available to users physically present inside Hartsfield-Jackson Atlanta International Airport (ATL). The Service enables users to connect for dating, professional networking, career interviews, event participation, and missed connections during their airport layover or transit.

The Service is provided "as is" and is subject to change at any time. We do not guarantee that the Service will be available at all times, uninterrupted, or error-free. We reserve the right to modify, suspend, or discontinue any feature of the Service at any time without notice.

4. User Conduct

You agree not to use the Service to:

• Post content that is false, misleading, defamatory, obscene, or otherwise objectionable.
• Harass, threaten, stalk, or intimidate other users.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Solicit money, financial information, or personal data from other users.
• Post spam, advertising, or unsolicited commercial messages.
• Upload or transmit viruses, malware, or any other harmful code.
• Attempt to gain unauthorized access to any part of the Service or its infrastructure.
• Scrape, crawl, or otherwise extract data from the Service without our express written consent.
• Violate any applicable local, state, national, or international law or regulation.
• Engage in any activity that could harm minors.

We reserve the right to remove any content and suspend or terminate any account that violates these standards, at our sole discretion and without prior notice.

5. User Content

You retain ownership of any content you post on GateSpark ("User Content"). By posting User Content, you grant GateSpark a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, adapt, publish, translate, and display such content in connection with operating and promoting the Service.

You represent and warrant that you own or have the necessary rights to post your User Content, and that your User Content does not infringe the intellectual property rights or privacy rights of any third party. You are solely responsible for your User Content and the consequences of posting it.

6. Premium Subscriptions

GateSpark offers a paid Premium subscription ("GateSpark Premium") that unlocks additional features. By subscribing, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate. Prices are subject to change with 30 days' notice.

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time except where required by law.

All payments are processed by Stripe, Inc. and are subject to Stripe's terms of service. We are not responsible for payment processing errors caused by Stripe.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of GateSpark and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. You may not copy, modify, distribute, sell, or lease any part of the Service without our express written permission.

8. Disclaimers

No guarantees of connections. GateSpark does not guarantee that you will make any matches, meet any people, land any job interviews, or have any particular experience through the Service. All interactions are between users and GateSpark is not a party to those interactions.

Safety. You are solely responsible for your safety when meeting other users in person. GateSpark does not conduct background checks on users. We strongly encourage you to meet in public areas of the airport and to trust your instincts.

No warranties. THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GATESPARK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THE SERVICE SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless GateSpark and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service shall be resolved by binding arbitration in Atlanta, Georgia, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause or notice, at our sole discretion. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes take effect constitutes your acceptance of the new Terms.
